In Construction, WSIB Is Not Optional

Construction is one of the few industries in Ontario where WSIB coverage is mandatory, even for independent operators and many sole proprietors. The rules are stricter than almost any other sector. Coverage is compulsory, clearance certificates are required before you get paid on most jobs, and the WSIB actively audits construction payroll. Get the classification wrong, miss a premium remittance, or hire a subcontractor without a valid clearance, and you can be assessed for their unpaid premiums on top of your own. For a contractor running on tight margins and multiple job sites, a WSIB problem is not just a fine. It can stop you from getting paid and pull you into an audit.

We provide WSIB compliance for construction companies across Ontario. Mandatory coverage setup, premium calculation and reporting, clearance certificate management, correct classification, reconciliation and full audit support. From $125/month. AFFORDABLE flat fees.

How We Keep Construction Companies WSIB-Compliant

A complete 6-step compliance process so coverage, premiums and clearances are never a problem. AFFORDABLE flat fees.

1

Mandatory Coverage Registration

In construction, coverage is compulsory. Getting registered correctly is step one.

  • Registration for compulsory WSIB coverage in the construction sector.
  • Independent operators and sole proprietors assessed, since many require mandatory coverage too.
  • Business activity reviewed to confirm which work is covered construction activity.
  • Optional coverage evaluated for owners and executives where it makes sense.
  • Account set up under your business number alongside payroll and HST.
2

Insurable Earnings and Premium Reporting

Premiums are based on insurable earnings, and the calculation has construction-specific rules.

  • Insurable earnings calculated per worker up to the annual maximum.
  • Premiums computed using your assigned rate and reported on schedule.
  • Reporting frequency (monthly, quarterly or annual) confirmed and managed.
  • Remittances made on time to avoid penalties and interest.
  • Owner and family-member earnings treated correctly for coverage purposes.
3

Clearance Certificate Management

No valid clearance, no payment. This is where most construction disputes start.

  • Your own clearance certificates kept valid so principals release payment.
  • Subcontractor clearances verified before you pay them, so you are not assessed their premiums.
  • Expired or invalid clearances flagged before they hold up a payment.
  • Records kept to prove you verified clearances, which protects you in an audit.
  • Clearance requests handled for you so you are never chasing paperwork on a deadline.
4

Correct Classification and Rate Group

The wrong classification means you overpay every premium, or face a reassessment.

  • Your business activity matched to the correct classification and rate.
  • Multiple activities split correctly where you do more than one type of work.
  • Misclassification corrected, which can lower your premiums going forward.
  • Rate changes reviewed each year so you are not paying an outdated rate.
  • Experience-rating impact reviewed where claims affect your premium.
5

Year-End Reconciliation

Reported earnings must match actual payroll. Mismatches trigger assessments.

  • Insurable earnings reported during the year reconciled to actual payroll.
  • Under-reported earnings corrected before the WSIB finds them.
  • Over-reported earnings recovered so you are not leaving money behind.
  • Reconciliation coordinated with your T4 and payroll filings for consistency.
  • Documentation prepared and retained to support the reconciliation.
6

WSIB Audit Support and Representation

The WSIB audits construction payroll often. We handle it for you.

  • Full representation if the WSIB selects your business for audit.
  • Records organized and presented: payroll, clearances, subcontractor agreements.
  • Subcontractor versus employee positions defended with proper documentation.
  • Assessments reviewed and disputed where the WSIB has it wrong.
  • Process fixed afterward so the same issue does not recur.

Case Studies: Construction WSIB Compliance

General Contractor, Brampton (12 Workers)

A general contractor was assessed for a subcontractor's unpaid WSIB premiums because no valid clearance was on file when payment was released. We put a clearance-verification process in place, corrected the reporting, disputed part of the assessment, and the contractor has had clean clearances on every job since. Get Started →

Assessment reduced. Clearance process fixed. Clean ever since.

Framing Subcontractor, Vaughan

A framing subcontractor was classified in too high a rate group and overpaying premiums for years. We reviewed the classification, had it corrected to the proper rate, and the premium cost dropped meaningfully going forward, improving margin on every job.

Reclassified to correct rate. Premiums reduced going forward.

Renovation Company, Mississauga (WSIB Audit)

A renovation company was selected for a WSIB audit with disorganized payroll and subcontractor records. We assembled the documentation, defended the subcontractor positions, and reconciled the insurable earnings. The audit closed with a far smaller adjustment than first proposed. Audit Support →

Audit defended. Records organized. Adjustment minimized.

Electrical Contractor, Toronto (New Setup)

A newly incorporated electrical contractor needed coverage, payroll and WSIB set up correctly from day one. We registered the WSIB account, set up automated payroll and premium reporting, and built clearance tracking so the business started fully compliant and stayed that way.

Set up compliant from day one. Payroll and WSIB automated.

Who Needs WSIB Coverage in Construction?

WhoCoverage in Construction
Construction companies with workersMandatory
Independent operators (no workers)Mandatory in most cases
Sole proprietors in constructionMandatory in most cases
Partners in a construction partnershipMandatory in most cases
Executive officers of a corporationOne may be exempt; others covered

Construction Is Different: In most other industries an independent operator with no employees does not need WSIB coverage. In construction, mandatory coverage extends to most independent operators, sole proprietors and partners. This catches many small contractors who assume they are exempt.

Frequently Asked Questions: Construction WSIB Compliance

Is WSIB coverage mandatory for construction companies in Ontario?
Yes. Construction is a sector where WSIB coverage is compulsory. This extends beyond companies with employees to most independent operators, sole proprietors and partners in construction.
Do I need WSIB if I am a one-person contractor?
In most cases yes. Unlike most industries, construction requires mandatory coverage even for many independent operators with no employees. This surprises a lot of small contractors who assume they are exempt.
What is a clearance certificate?
A document from the WSIB confirming a business has an active account and is in good standing on premiums. Principals require a valid clearance before releasing payment, and you should require one from every subcontractor.
Why do I need a clearance certificate to get paid?
Principals and general contractors can be held responsible for a subcontractor's unpaid WSIB premiums. To protect themselves, they require a valid clearance before paying you. No clearance often means no payment.
What happens if I pay a subcontractor without a clearance?
You can be assessed for that subcontractor's unpaid WSIB premiums. Verifying and keeping a record of a valid clearance before paying protects you from this liability.
How are WSIB premiums calculated?
Premiums are based on your insurable earnings, up to an annual maximum per worker, multiplied by the premium rate for your classification. Reporting the correct earnings and using the correct rate is essential.
What are insurable earnings?
The portion of each worker's earnings on which premiums are calculated, up to the annual maximum set by the WSIB. Earnings above the maximum per worker are not subject to premiums.
What is a classification or rate group?
The WSIB classifies your business activity into a group with a set premium rate reflecting the risk of that work. Construction trades carry different rates. The wrong classification means you overpay or face reassessment.
What if I am in the wrong classification?
If you are over-rated, you have been overpaying premiums and we can have it corrected going forward. If you are under-rated, the WSIB can reassess you. We review and fix classification.
How often do I report and pay premiums?
Monthly, quarterly or annually depending on your account. The WSIB assigns a frequency based on your premium size. We manage the reporting and remittance on your schedule.
What happens if I report or pay late?
The WSIB charges penalties and interest on overdue premiums. Repeated lateness draws closer scrutiny. Automated reporting through your accountant prevents this.
What is WSIB year-end reconciliation?
A comparison of the insurable earnings you reported during the year against your actual payroll. Differences are corrected. Under-reporting found here, or on audit, leads to assessments.
Does the WSIB audit construction companies?
Yes. Construction is audited more than most sectors. Auditors review payroll, subcontractor records and clearances. Good records and proper subcontractor documentation are your best protection.
What does the WSIB look at in an audit?
Your payroll records, insurable earnings reported, subcontractor agreements and clearances, and whether subcontractors were correctly treated as independent rather than employees.
Can you represent me in a WSIB audit?
Yes. We organize your records, defend subcontractor and classification positions, reconcile earnings, and deal with the auditor on your behalf. Audit Support →
Are owners and executives covered?
In a construction corporation, one executive officer may be eligible for an exemption while others are covered. Sole proprietors and partners generally require mandatory coverage. We confirm your situation.
Is home renovation work exempt?
There are specific exemption rules for certain home renovation work performed directly for a private homeowner. The rules are narrow, so it is worth confirming whether your work qualifies before relying on it.
How is WSIB different from regular payroll source deductions?
Source deductions (CPP, EI, income tax) go to the CRA. WSIB is a separate workplace insurance premium paid to the WSIB. Both are based on payroll, and we handle them together.
Do I need WSIB and payroll if I only use subcontractors?
If you have no employees, you may not run payroll, but you still need your own WSIB coverage in construction and must verify subcontractor clearances. We set this up correctly.
What if a subcontractor is really an employee?
If the WSIB or CRA determines a subcontractor is actually an employee, you can owe premiums, source deductions, penalties and interest. We document arrangements properly to support genuine subcontractor status.
Can you set up WSIB for a brand-new construction company?
Yes. We register the WSIB account, confirm classification, set up payroll and premium reporting, and build clearance tracking so you start fully compliant from day one.
How much does construction WSIB compliance cost?
Payroll with WSIB reporting starts at $125 per month for the first employee. Registration setup and year-end reconciliation start at $250 each. All fees include HST.
Is WSIB included with your payroll service?
Yes. WSIB premium reporting is handled as part of our construction payroll service, coordinated with source deductions and T4s. Payroll Services →
Do you also handle my corporate tax and bookkeeping?
Yes. We handle bookkeeping, HST, payroll, WSIB and your T2 corporate tax together, so your construction compliance is in one place. Construction Services →
Can you fix a WSIB account that is already behind?
Yes. We bring overdue reporting current, reconcile insurable earnings, correct classification, and deal with any assessment, then put a clean process in place going forward.
Are your fees inclusive of HST?
Yes. All quoted fees include HST, so the number you are quoted is the number you pay.
How do I pay your fees?
Payment is by Interac e-Transfer to info@gondaliyacpa.ca. Auto-deposit is enabled, so no security question is needed.
Do you serve construction companies outside Toronto?
Yes. We handle WSIB, payroll and tax for construction companies across the GTA and all of Ontario virtually, with the same flat-fee pricing.
How does WSIB compliance support my main construction accounting?
WSIB sits inside the bigger picture of construction compliance: bookkeeping, HST, payroll, holdbacks, work-in-progress and your T2 corporate tax. Handling WSIB alongside the rest keeps your records consistent and audit-ready. Construction Accounting →
